Overview

In 2023, the federal government awarded a record $765 billion in contracts, $470 billion from DoD alone. Federal prime and sub-contractors performing on federal projects are responsible for contract compliance including all clauses incorporated in the award. These contract clauses include wage, product, manufacturing, cyber, security, and other regulations that directly impact businesses throughout the contract supply chain. Prime contractors, even when delegating work to sub-contractors, must effectively manage flow-down clauses to ensure that all vendors supporting the contract remain compliant. Subcontractors must understand which clauses apply to them and maintain the controls necessary to ensure compliance as well.

Mitigating Risk:

Noncompliance can result in significant risk to businesses performing on these contracts including fines, penalties, poor CPARS ratings and loss of current and future federal contracts. In order to effectively mitigate risk, prime contractors must understand all applicable clauses and ensure their vendors throughout their entire supply chain do the same.
